ACCOUNTABILITY & RESPECT
Womxn of Color Weekend (hereinafter WoCW) in Provincetown, MA is a celebratory gathering of LGBTQIA+ women of color, non-binary, trans- and gender-fluid people of color, their accomplices, friends and families! The Planning Squad is dedicated to fostering a welcoming, safe, and non-oppressive environment. We understand safety is relative, so in this case we specifically mean safe from violence such as, but not limited to, all forms of harassment, transphobia, biphobia, homophobia, racism, sexism, classism and/or misogyny between attendees. 

Any person who has registered for an admission pass, single event or in any other way intends to participate in a WoCW event (hereinafter “Attendee”) that engages in oppressive, bullying, bigoted, non-consensual and/or violent behavior will be:

  • Asked to leave an event or workshop 

  • Have their access to remaining events revoked 

  • Prohibited from attending future WoCW events 

Additionally, refunds will NOT BE issued to attendees if their access is revoked for aforementioned behavior. We ask that you also let Planning Squad Members know of issues you may have with any of the venues we are partnered with throughout this weekend. 

 

REFUNDS

All sales, including partial payments and deposits, are final at the time of purchase. No refunds are available. This includes, but is not limited to, event pass registration, lodging registration, merchandise purchases, and donations/sponsorships.
 

PHOTO/VIDEO RELEASE

The Attendee agrees and releases WoCW and their Collaborators (vendors, sponsors, representatives and agents) from any liability, loss, expense or claims arising from distribution, broadcast, sale or use of their likeness or voice as a result of attending the Weekend. 

The Attendee further acknowledges and agrees that their image may appear in pictures or video taken during the weekend. The Attendee agrees that WoCW may use images and video for promotional and advertising purposes. The Attendee hereby authorizes the reproduction, sale, copyright, broadcast and /or distribution of said video, sound recording, and pictures without limitations. 
 

If an Attendee desires not to be included in any promotional pictures or video produced by WoCW, there will be an opportunity during registration to acquire a wearable item (typically in the form of a lanyard, pin, or bracelet) signifying that preference. Every attempt will then be made to exclude those attendees who are wearing the lanyard, but no guarantee can be made by WoCW that the attendee will not be inadvertently included. However, no photos of those attendees will be posted or used for social media, marketing or other public uses. 
 

The Attendee also agrees and acknowledges that WoCW has no control over other participants use of pictures or videos taken and agrees to hold harmless WoCW for their appearance in any other attendees/participants’ images, video or livestreaming.

AGE

The Attendee also certifies that they are 21 years of age or older for party and club admission. 

 

WAIVER OF CLAIMS

To the extent permitted by law, the Attendee waives any and all claims and rights against WoCW, our affiliates, parents, and successors and each of our and their employees, assignees, officers, agents and directors (collectively, the “WoCW Parties”) from and against any and all actions, causes of action, suits, claims, rights, damages, losses, expenses or demands of any kind or nature whatsoever which an attendees has now or may in the future have in connection with (i) destruction, theft, or loss of, any property, person or pet, arising from or relating to the attendee participating in any WoCW produced or co-sponsored events, except in the case of gross negligence or willful misconduct of the undersigned WoCW Party, including, but not limited to, any and all claims for any bodily injury, including death.

 

INDEMIFICATION 

The Attendee indemnifies and holds harmless the WoCW Parties for any damages, claims, losses, penalties, fines or liabilities (including any reasonable attorney fees or costs) arising from or relating to (i) injuries to property or persons occurring in or about the event premises arising from or relating to an action or omission by the attendee, (ii) theft, or the misappropriation of property in the event premises arising from or relating to an action or omission by the attendee, (iii) the negligence or willful misconduct the attendee. WoCW will indemnify and hold harmless the Attendee for any third party damages, claims, losses, penalties, fines or liabilities (including any reasonable attorney fees or costs) arising from or relating to the gross negligence or willful misconduct of WoCW. The Attendee is responsible for the actions of and all damages caused by the Attendee. The Attendee agrees that they bear the risk of loss, damage, theft or misappropriation of all of their property in the event spaces and premises, and the liability for the same. Each party agrees that it shall not make any settlement that requires an act or admission by a party or imposes any obligation upon the other party without its written consent. No party shall be liable for any settlements made without its prior written consent.
